Phase II of Stark II Regulations Finally Released
On March 26, 2004, the Centers for Medicare and Medicaid Services ("CMS") released the long-awaited Stark II Phase II regulations. The Phase II regulations, effective July 26, 2004, modify a number of Phase I provisions and establish new regulatory exceptions to the Stark self-referral prohibition. Phase II also addresses a variety of compensation arrangements not dealt with in the Phase I rulemaking process, including employment relationships, personal services arrangements, physician recruitment and office space and equipment leases. FLSA: New FLSA Overtime Regulations Published
On April 23, 2004, the U.S. Department of Labor (“DOL”) published new overtime rules for the Fair Labor Standards Act (“FLSA”). The rew regulations primarily clarify the white-collar exemptions for executive, administrative and professional employees. The new rules are final and will take effect on August 23, 2004. Attempts to set aside the regulations have been unsuccessful to date. To learn more about the new regulations, go to the DOL’s website
